A very grey area. Is it a matter of Unsplash carrying images that were uploaded by someone other than the original photographer or a case of a get rich quick lawers using fake copyright infringements, as per the single comment pointing to Prenda Law. Unsplash really need to tighten up their licence description as on one page they state there's no restrictions whilst deeper down they state you shouldn't use:

Note that the Unsplash License does not include the right to use:
    • Trademarks, logos, or brands that appear in Photos
    • People’s images if they are recognizable in the Photos
    • Works of art or authorship that appear in Photos

So all in all a minefeild.

There was something a little similar here in the States where this one firm that was an association of news papers and publishers, was suing every blogger and forum sites that was referencing news stores with links back to the original site for copyright infringement. Several paid big bucks but final one fought back. The courts ruled that the firm could not sue for these types of copyrights because it was deemed fair use and that the firm was doing these types of suites as copyright trolling.

Usually in these types of cases if you tell them you will remove the image there is no problem.
