I think your words in response were right on. But I have to admit, I really like Ramwolff's concept!
Besides that, this is an international site, and we have friend here from all over the world. I don't think we should be concerning ourselves here with our nationalistic positions.

Now, back to the confusion.
So far in this thread we have been discussing each and everyone's opinion as to what the copyright laws really are in the matters of derivative works. From first post until now. But now, Maya has posted direct quotes from sections of the statutes, specifically section 103 concerning derivative work and copyright of such.
By what this section is saying, a derivative work is a work that incorporates part or parts of a pre-existing copyrighted work in the new work. It even spells out that the copyright of the new work only covers the new parts of that work, the pre-existing parts contained in the new work are still, only covered by their original copyright. Unless there is another section, or another part of this section that expands on that concept, something like my painting of the American flag would not be considered a derivative work. My painting has no part or parts of a pre-existing copyrighted work in it. I have a complete .xar file on my hard drive containing all of the parts of my painting created by no one but myself.
Now, I'm not saying that Gary wouldn't have a claim if I were to use my painting in a commercial way, because I don't know. I'm just saying that from what Maya has posted, and it being the only piece of factual information presented, it doesn't appear that my painting can be considered a derivative work. If that's the case, then does it become an original, able to be copyrighted?
The more I started thinking about this I started thinking of some of Andy Warhol's last works. Almost all of them were paintings of copyrighted material. Everything from Campbell's soup cans to Amaco and Standard Oil logos. Now, Andy may in fact have gotten permission to use these images (although that doesn't sound like Andy), but nowhere will you find the description attached to any of his work as a derivative.
All of his painting are called original Andy Warhol paintings.
I have tried to find more info at the U.S. Copyright site and I just can't read anymore of it. But, from what I have been able to find and what Maya has provided, the whole matter is just all that much more confusing to me.

I was rather bummed-out from the affore-mentioned rudeness, and with that said, I sought solace from Risto's site---and was IMMEDIATELY cheered up and felt much better!!!!! The copyright thread is an important one, it is confusing, but I think we are discovering new things about it that can be helpful---everyone's postings (except one) has been informative and I have learned a lot. I don't think discussing art topics is a bad thing. I respect everyone's views here and I have learned enough to say I think I had wrong ideas about copyright matters, but people here have changed my mind and I think it is a good thing. I love to hear others opinions from around the world. How can we learn if we can't share this way???
Anyway, I think we are making some headway into understanding parts of copyright---and at least what we need to be really careful about. If I find something more of interest I'll post it tomorrow. Thanks again Jack, RAMWolff, Risto, DMagician, and everyone else for all the info, it's really appreciated and I DO consider you all friends even the miles between us may be great. While I can see that several people have found this discussion to be a real eye-opener, it seems to be going on for rather a long time. So I just want to take this opportunity to respectfully remind all the wonderful artists here that this is the gallery, and I, for one, am starting to miss your pictorial input to it. I've attached a drawing expressing my feeling that this discussion threatens to eat up a lot of valuable Xara-ing time, with little further light appearing at the end of the tunnel of the extremely ambiguous legal maze of copyright law.

the last post of yours was very well expressed. My feelings exactly. I'm going to keep doing research myself and will keep everyone posted if I come upon anything that makes the issue any clearer.
Glen, You do make a good point too. This thread started quite by accident, and I think the length of it shows that a lot of people are interested in the topic. And, I think we are making some headway in the subject. I do agree with you though, I'm going to get back to doing a little more painting myself.
