Ah, my fault regarding the first ...bug... -yes it must be one! ;)
-I just discovered it's only when you use Shape editor tool (or the Pen tool) and manipulate the curve (not the handles)....

Stumbled upon some strange behaviour when drawing, example in attached .xar file;
One point in closed shapes remains cusp join although it was just set to smooth.
Subtract shapes produces...
